Acceptance of these Terms
These Terms of Service ("Terms") govern your access to and use of Gulag's websites, waitlist, referral program, beta access tools, tournaments, and related services (collectively, the "Services"), operated by Gulag ("Gulag," "we," "us," or "our"). By using the Services, you agree to these Terms. If you do not agree, do not use the Services.
Eligibility
You must be at least 18, or the age of legal majority where you live if higher, and legally capable of entering a binding agreement. You may not use the Services if doing so is prohibited by law, sanction, regulation, or a restriction applicable to you. You are responsible for determining whether your use is lawful in your location.
Accounts and security
You may sign in using email or Google and may optionally connect a wallet or X account. You are responsible for information submitted through your account and for protecting your email, social account, wallet, device, and authentication credentials.
Never share a private key or seed phrase with us. Gulag will not ask for either. Notify us promptly at team@gulag.xyz if you believe your account has been compromised.
Waitlist, points, and referrals
Waitlist placement, points, ranks, referral counts, codes, and rewards are promotional features. They have no cash value, are not property, are not transferable, and do not guarantee beta access, prizes, tokens, allocations, or any other benefit.
We may verify referrals, correct errors, remove duplicate or fraudulent activity, adjust points, modify reward rules, or end the program. You may not self-refer, create fake accounts, automate signups, spam, or misrepresent Gulag when sharing a referral link.
Beta service
Gulag may be offered as an experimental or pre-release service. Features may be incomplete, contain errors, change without notice, or be reset. We may invite or remove testers, limit access, pause features, wipe test data, or discontinue the beta at any time. Do not rely on beta features for critical activity.
Trading and digital-asset risk
Trading, tournaments, leverage, and digital assets involve substantial risk. Prices can move rapidly, losses may equal or exceed amounts you commit where permitted, liquidity may disappear, and blockchain transactions may be irreversible. Smart contracts, wallets, networks, or third-party venues may fail or be exploited.
You are solely responsible for your decisions, transaction fees, taxes, wallet security, and compliance obligations. Only use funds you can afford to lose.
No financial advice or fiduciary duty
The Services and all related content are for informational and entertainment purposes only. Nothing is financial, investment, legal, accounting, or tax advice, a recommendation, an offer to buy or sell an asset, or a promise of profit. No fiduciary, brokerage, advisory, or custodial relationship is created. Obtain independent professional advice where appropriate.
Wallets, networks, and third parties
Optional authentication, social connections, wallets, blockchains, trading venues, and other integrations are operated by third parties. Their terms and privacy policies apply to your use of them. We do not control and are not responsible for their security, availability, accuracy, fees, content, acts, or omissions. Your wallet actions and blockchain transactions require your authorization and are your responsibility.
Acceptable use
You agree not to:
- break any law or another person's rights;
- manipulate tournaments, referrals, rankings, or markets;
- use bots or coordinated accounts unless expressly permitted;
- probe, disrupt, overload, bypass, or compromise the Services;
- scrape or copy the Services except as lawfully authorized;
- introduce malware or attempt unauthorized access; or
- use Gulag to facilitate fraud, sanctions evasion, or abuse.
Ownership and feedback
Gulag, its software, design, branding, content, and related intellectual property belong to Gulag or its licensors. Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose. If you submit feedback, you allow us to use it without restriction or compensation.
Suspension and termination
You may stop using the Services at any time. We may restrict, suspend, or terminate access if we reasonably believe you violated these Terms, created risk, engaged in abuse, or if required for legal, security, or operational reasons. Sections that by their nature should survive will remain in effect after termination.
Changes and availability
We may modify, suspend, or discontinue any part of the Services at any time. Information, rankings, market data, and results may be delayed, incomplete, or inaccurate. We do not guarantee uninterrupted access, continued availability, a particular feature set, or preservation of data.
Disclaimers
To the maximum extent permitted by law, the Services are provided "as is" and "as available" without warranties of any kind, express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, security, or availability. Nothing in these Terms excludes a warranty that cannot lawfully be excluded.
Limitation of liability
To the maximum extent permitted by law, Gulag and its affiliates, officers, employees, contractors, and licensors will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; loss of profits, data, goodwill, opportunities, digital assets, or funds; or losses arising from market movement, account compromise, smart contracts, networks, wallets, third parties, or your use of or inability to use the Services. Nothing limits liability that cannot be limited by law.
Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Gulag and its affiliates, officers, employees, contractors, and licensors from claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Services, your violation of these Terms or law, or your infringement of another person's rights.
Governing law
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable there, without regard to conflict-of-law rules. The courts located in Ontario, Canada will have jurisdiction over disputes, except where applicable consumer law gives you the right to bring a claim elsewhere.
General terms
These Terms and the Privacy Policy form the agreement between you and us regarding the Services. If a provision is unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them as part of a reorganization or transfer of the Services.
Changes and contact
We may update these Terms as the Services change. The date above shows when they were last revised. Continued use after updated Terms take effect means you accept them, to the extent permitted by law.
